This is the Matter that I spoke to you on the phone earlier this morning regarding my lawsuit I filed in Ct. Superior Court and lost over The 2 year Statute of Limitations. Atty. Michael Oleyer from Traveler's represented The Town of Windsor represented them on this case.
This lawsuit filed was regarding damage that happened to my house over a Illegal permit allowed by the Town of Windsor's Building Dept. In 2016 my central heater stopped working, I went down to my basement to press the restart button, when I got there, water/melted snow had flowed into the basement from a hole in the basement window, there were rats/field mice running around, and the water had run over to the motor of the heater and stopped it from running. The hole in the window was caused by a falling board of ice that slid off my neighbor's red metal roof that The Town of Windsor's Asst. Building. I just talked to Craig Smiley who said my case was lost by the TWO year Statute of Limitations. I will refile my case again, now against Travelers Insurance because Atty. Oleyer DID Not use RISK Insurance to Cover Employee NEGLIGENCE which Risk Insurance Covers.

I still have Not rec'd a comment regarding my complaint regarding this matter, however, while I have my lawsuit on-going, Windsor can not provide me any proof that Robert Ruzzo had a up-dated License at the time he issued this Illegal permit, so why did Windsor allow Ruzzo to issue the permit in the first place!
As of today, July 30th, I have now discovered that Windsor used their Risk Insurance, that is required to have in my Municipality Budget, that I help pay for, with my property taxes, for this disgusting house, that is rotting away from the damage, Windsor used the Risk Insurance that Traveler's Insurance provides to All Ct. Municipalities, has paid the Town of Windsor, $2.5 Million dollars to replace the Windsor High School Roof that also was damaged by snow, basically the same type of damage that I have, and Windsor lost their lawsuit also, over the Statute of Limitations they filed over the Construction company. Plus, The Town of Windsor had hired Atty. Oleyer, from Cynthia Garraty Law Firm to represent them, he used a PO box from Hartford, Now I have discovered that Oleyer actually works for Cynthia Garraty's Law firm in Hamden Ct. which is a much bigger Law Firm located in Hamden, Ct. that represents TRAVELER'S Risk Insurance! So Sneaky Mayor Trink's knew all along that I should have been covered on my damages for the illegal permit. He is a Nasty man, who cares about "BARTS"
Now, after I lost my original lawsuit that I filed in Jan. 2019 over the illegal permit that was issued by the town of Windsor to allow my neighbor's roof to be placed on their roof, I continued to research! I lost because I did not find the "cause of action" as claimed! I refiled after searching over and over, looking for similar lawsuits in other states filed against other Municipalities and I could find nothing! Then I looked through the Town's council meetings which were posted and available to read on Windsor's website, (NOT NOW!) going all the way back to the year of 2010. Manager Souza discussed to the Council members at two different meetings the fact that both the Assistant and Official building dept. supervisor job applications needed to be revised to hire new employees. These new revised applications failed to state the newly hired employees would be required to attend the States required training classes, every three years to learn the states updated codes, laws, rules and regulations. That was because town manager Souza never knew this was a requirement and the employees were never sent to attend any of these classes. That was why my permits for my own house and my neighbor's house was issued illegal. I refiled in 2023.
Instead of responding to this as neglect, the Town Manager Souza arranged to have my damaged property evaluated to an excessive OVER-EVALUATED assessment rate for the 2023 5-year value. After I had lost my first lawsuit in Oct. 2023, I had my property re-evaluated to a much lower value because it was too damaged by the town's property assessor. In Ct, if your property has been evaluated to a lower value, your property cannot be assessed again until you either fix or repair your property damages, then you be able to have your house re-evaluated! This new high over-evaluated rate increased my home-owners insurance too high. I was forced to sell my house because of this. This was fraud and I discovered he had my house evaluated too high, at a regular value for a property like the size of my house even though he was and the town property assessor were both aware that my property was too damaged to be worth this value!
I have now filed a new lawsuit against Souza over Fraud! Fraudulent concealment and other charges! His attorney also assisted with him and that is in my complaint also. Isn't it funny that as soon as my first lawsuit was finished, Souza replaced Ruzzo with a new licensed and trained Official Building Supervisor and now when a permit needs to be applied for, the applicant has to do it themselves, via a computer so that the Town is not responsible!
